These Terms and Conditions (“Terms”) govern your use of royaltreepinellas.com (the “Site”) and the tree care, landscaping, hardscaping, lawn care, hauling, and related services offered by Royal Tree Services (“Royal Tree,” “we,” “us,” or “our”).

By using the Site, requesting an estimate, accepting a proposal, scheduling services, or authorizing work, you agree to these Terms where applicable.

A written estimate, proposal, work order, contract, or change order may contain additional terms. If project-specific written terms conflict with these general Terms, the project-specific terms will control with respect to that particular project.

1. Services

Royal Tree Services may provide residential and commercial services including:

  • Tree removal;
  • Limb and branch removal;
  • Tree trimming;
  • Tree pruning;
  • Arborist-related tree care;
  • Stump grinding and removal;
  • Root pruning;
  • Yard-waste removal;
  • Landscaping;
  • Lawn care;
  • Hardscaping;
  • Paving or related landscape construction;
  • Storm preparation;
  • Hazardous-tree or limb work; and
  • Related property-maintenance services.

Service availability depends on project location, site conditions, weather, equipment, personnel, permits, safety requirements, and other circumstances.

2. Estimates and Quotations

Royal Tree Services may provide free written estimates or quotations based on information available at the time of inspection.

Unless expressly identified as a guaranteed fixed price, an estimate is based upon anticipated:

  • Tree size and condition;
  • Number and location of trees or limbs;
  • Access;
  • Equipment requirements;
  • Labor;
  • Debris volume;
  • Stump or root conditions;
  • Nearby structures;
  • Disposal requirements; and
  • Other observable site conditions.

An estimate may change if actual conditions materially differ from what was reasonably apparent when the estimate was prepared.

3. Changes in Scope and Additional Work

Additional charges may apply when:

  • Additional trees, limbs, stumps, or debris are added;
  • Tree conditions are materially different from those originally observed;
  • Hidden decay or structural defects are discovered;
  • Additional equipment or personnel becomes necessary;
  • Access conditions change;
  • Underground or concealed conditions are encountered;
  • Customer-requested changes expand the work; or
  • Governmental, utility, or safety requirements require additional work.

Where reasonably practicable, material changes in scope and price will be communicated before additional work is performed.

4. Scheduling

Project dates and arrival times are provided in good faith but are not guaranteed unless expressly agreed in writing.

Scheduling may be affected by:

  • Rain;
  • Lightning;
  • High winds;
  • Hurricanes or tropical storms;
  • Storm emergencies;
  • Unsafe ground conditions;
  • Equipment failures;
  • Traffic;
  • Disposal-facility delays;
  • Permit delays;
  • Utility coordination;
  • Prior emergency jobs; and
  • Other circumstances outside our reasonable control.

We may postpone work where weather or site conditions make tree work unsafe.

5. Emergency and Storm Work

Storm-damaged, leaning, uprooted, cracked, or otherwise hazardous trees may require immediate safety measures or specialized equipment.

Emergency service availability is not guaranteed.

Emergency work may carry different pricing because of increased hazards, demand, equipment requirements, after-hours labor, accessibility, or disposal conditions.

A tree that appears stable may contain concealed storm, root, trunk, or structural damage. Royal Tree Services cannot guarantee that an inspected tree will never fail in the future.

6. Customer Responsibilities

Customers agree to:

  • Provide accurate property and project information;
  • Clearly identify the trees, limbs, roots, stumps, or areas included in the requested work;
  • Provide reasonable and safe access to the work area;
  • Identify known hazards and property restrictions;
  • Secure pets and keep children and unauthorized persons away from active work areas;
  • Move vehicles and personal property where reasonably requested;
  • Obtain necessary property-owner or homeowners’ association authorization;
  • Identify known private utilities or underground improvements; and
  • Provide timely access and project decisions.

7. Authority to Perform Work

By authorizing services, you represent that you:

  1. Own the property where work will be performed; or
  2. Have lawful authority from the property owner to order the work.

You are responsible for obtaining consent from co-owners, landlords, property managers, homeowners’ associations, or other parties where required.

We may refuse or stop work if ownership or authority is disputed.

8. Property Lines and Neighboring Trees

Customers are responsible for accurately identifying property boundaries.

If a tree, branch, root system, or work area is located on or near a property line, we may require evidence of authority or neighboring-owner consent before proceeding.

Royal Tree Services does not determine legal property boundaries and is not responsible for boundary disputes based on inaccurate information supplied by the customer.

Customers should obtain a professional survey or legal advice when property ownership is uncertain.

9. Permits and Protected Trees

Tree removal or substantial pruning may require permits or approvals depending on location, tree type, size, zoning, environmental restrictions, or municipal regulations.

Responsibility for obtaining and paying for permits will be determined by the applicable estimate or project agreement.

If a customer is assigned responsibility for obtaining a permit, the customer represents that all required approvals have been secured before work begins.

Royal Tree Services may suspend or refuse work where necessary permits or approvals have not been obtained.

10. Tree Condition and Risk

Trees are living organisms affected by age, disease, pests, decay, root conditions, soil, lightning, wind, drought, rainfall, construction activity, and other environmental factors.

Even apparently healthy trees may contain concealed defects.

Any recommendation, inspection, trimming, or service reflects conditions reasonably observable at the time and does not guarantee that a tree or limb will never:

  • Fail;
  • Fall;
  • Split;
  • Develop disease;
  • Sustain storm damage; or
  • Require additional work.

Unless expressly agreed in writing, our services are not a guarantee against future tree failure.

11. Tree Removal

Tree removal involves inherently hazardous work and may require climbing, rigging, chainsaws, cranes, bucket trucks, loaders, ropes, or other specialized equipment.

The exact method of removal will be determined by Royal Tree Services based on safety, access, tree condition, surrounding structures, and equipment requirements.

Customers must remain outside designated work areas while removal operations are underway.

12. Stump Grinding and Removal

Unless otherwise agreed, stump grinding may leave:

  • Wood chips;
  • Grindings;
  • Subsurface roots;
  • Soil disturbance;
  • Depressions or holes; or
  • Material beneath the original stump location.

Stump grinding does not ordinarily remove an entire underground root system.

Underground objects near stumps may include:

  • Irrigation systems;
  • Electrical lines;
  • Landscape lighting;
  • Drainage pipes;
  • Invisible fencing;
  • Water lines;
  • Utility components; or
  • Other concealed improvements.

Customers are responsible for disclosing known private underground systems before grinding begins.

13. Root Pruning

Root pruning may affect tree stability, health, or future growth depending on the tree species, age, root structure, soil conditions, and extent of pruning.

Customers acknowledge that root systems are partly concealed and may extend farther than visibly apparent.

Where appropriate, Royal Tree Services may recommend limiting or declining root work when it could materially compromise tree stability.

14. Tree Trimming and Pruning

Tree trimming and pruning are intended to improve safety, structure, clearance, appearance, or tree health according to the agreed scope.

Tree growth is natural and continuing. Royal Tree Services does not guarantee that:

  • Branches will not regrow;
  • Additional pruning will never become necessary;
  • All future limb failure will be prevented; or
  • A tree will remain healthy indefinitely.

15. Landscaping and Hardscaping

Landscaping and hardscape services may be affected by:

  • Soil conditions;
  • Drainage;
  • Irrigation;
  • Existing vegetation;
  • Root systems;
  • Material availability;
  • Weather;
  • Customer maintenance; and
  • Other site-specific conditions.

Natural plants and materials may vary in appearance, size, color, growth, and performance.

Project-specific specifications will be governed by the applicable proposal or contract.

16. Underground Utilities and Private Systems

Public utility-locating procedures may be used when appropriate or legally required.

However, public marking services may not identify privately installed systems.

Customers must disclose known private systems including:

  • Irrigation lines;
  • Landscape lighting;
  • Pool equipment;
  • Private electrical wiring;
  • Drainage;
  • Septic systems;
  • Invisible fences;
  • Private water lines; and
  • Similar underground installations.

Additional charges may apply if undisclosed concealed conditions interfere with the work.

17. Access and Heavy Equipment

Tree and landscape work may require trucks, cranes, bucket trucks, loaders, stump grinders, trailers, chippers, or other heavy equipment.

Customers authorize reasonable access necessary to perform agreed services.

Customers should identify:

  • Septic fields;
  • Underground tanks;
  • Weak driveways;
  • Pavers;
  • Irrigation systems;
  • Drainage structures;
  • Decorative landscaping;
  • Soft or saturated ground; and
  • Other areas that may not support heavy equipment.

We will exercise reasonable care but are not responsible for damage resulting solely from concealed conditions that were not reasonably observable or disclosed.

18. Lawn and Landscape Disturbance

Tree removal and related work may cause reasonable and unavoidable disturbance to:

  • Lawns;
  • Mulch;
  • Soil;
  • Landscaping;
  • Driveways;
  • Pavers; or
  • Nearby vegetation.

Reasonable efforts will be made to minimize disturbance consistent with safe completion of the job.

Restoration of disturbed lawn, soil, landscaping, or hardscape is included only when expressly stated in the applicable project agreement.

19. Debris and Wood Removal

Unless otherwise stated in the estimate, the parties should confirm whether the job includes:

  • Branch removal;
  • Log removal;
  • Wood-chip removal;
  • Stump grindings;
  • Yard waste;
  • Firewood;
  • Cleanup; or
  • Hauling and disposal.

Materials intentionally left at the property at the customer’s request become the customer’s responsibility.

20. Tree and Plant Survival

Pruning, root work, transplantation, storm damage, pests, disease, environmental conditions, and other factors may affect tree or plant health.

Unless expressly covered by a written warranty, Royal Tree Services does not guarantee survival, future growth, or future condition of trees, shrubs, lawn, or other living materials.

21. Satisfaction Guarantee

Royal Tree Services advertises a satisfaction guarantee.

Any satisfaction guarantee applies to the agreed scope of work and reasonable workmanship concerns.

It does not require:

  • Unlimited additional services;
  • Work outside the original scope;
  • Replacement of healthy trees or landscaping solely because of a change in customer preference;
  • Correction of damage caused by weather, disease, pests, third parties, or lack of maintenance; or
  • Correction of conditions outside Royal Tree Services’ reasonable control.

Where a concern relates to workmanship, Royal Tree Services must be given a reasonable opportunity to inspect and, where appropriate, remedy the issue.

22. Payment

Customers agree to pay charges specified in the accepted estimate, proposal, invoice, or contract.

Additional authorized work may result in additional charges.

Unless otherwise stated in writing, payment is due according to the payment schedule provided for the applicable project.

23. Cancellations and Rescheduling

Customers should provide reasonable notice when cancelling or rescheduling services.

Royal Tree Services may postpone or cancel work because of:

  • Unsafe weather;
  • Hazardous property conditions;
  • Permit or utility issues;
  • Equipment failure;
  • Customer-access issues;
  • Emergencies; or
  • Other circumstances outside our reasonable control.

Any project-specific cancellation fee or deposit policy will be governed by the applicable written proposal or agreement.

24. Photographs and Project Documentation

Royal Tree Services may photograph work areas before, during, and after services for legitimate business purposes, including project documentation, safety, estimating, and dispute resolution.

Use of identifiable private-property photographs for promotional or advertising purposes will be subject to appropriate authorization where required.

25. Website Information

Information on the Site is provided for general informational and marketing purposes.

Website content does not replace a project-specific written estimate, proposal, contract, permit requirement, or professional tree assessment.

Descriptions of services, availability, timing, results, or pricing may change.

26. Third-Party Websites

The Site may contain links to social media, review sites, maps, suppliers, or other independently operated websites.

Royal Tree Services does not control and is not responsible for third-party content, services, security, privacy practices, or availability.

27. Intellectual Property

Unless otherwise indicated, the Site’s original text, graphics, photographs, design, branding, and other proprietary materials are owned by or licensed to Royal Tree Services.

You may not reproduce, commercially exploit, or systematically copy proprietary Site content without permission except as permitted by law.

28. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TREE AND LANDSCAPE CONDITIONS MAY CHANGE BECAUSE OF WEATHER, DISEASE, PESTS, SOIL, ROOT CONDITIONS, AGE, CONSTRUCTION ACTIVITY, AND OTHER ENVIRONMENTAL FACTORS.

EXCEPT FOR ANY EXPRESS WRITTEN WARRANTY OR GUARANTEE PROVIDED FOR A PARTICULAR PROJECT, WE DISCLAIM IMPLIED WARRANTIES TO THE EXTENT PERMITTED BY APPLICABLE LAW.

29. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROYAL TREE SERVICES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SITE OR SERVICES.

FOR A CLAIM ARISING FROM A PARTICULAR PROJECT, OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT PAID TO ROYAL TREE SERVICES FOR THE PORTION OF THE PROJECT GIVING RISE TO THE CLAIM, EXCEPT WHERE SUCH A LIMITATION IS PROHIBITED BY APPLICABLE LAW.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

30. Indemnification

To the extent permitted by applicable law, customers agree to indemnify and hold harmless Royal Tree Services and its owners, employees, and agents from third-party claims arising from:

  • The customer’s lack of authority to authorize work;
  • Incorrect property-boundary information provided by the customer;
  • Undisclosed underground improvements or hazards;
  • The customer’s violation of these Terms; or
  • Customer instructions that infringe another person’s property or other legal rights.

31. Force Majeure

Royal Tree Services is not responsible for delays or inability to perform caused by circumstances reasonably outside our control, including:

  • Hurricanes;
  • Tropical storms;
  • Lightning;
  • Flooding;
  • Severe weather;
  • Governmental restrictions;
  • Road closures;
  • Utility interruptions;
  • Equipment failures;
  • Supply shortages;
  • Disposal-facility closures; or
  • Similar events.

32. Governing Law

These Terms and services are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Subject to applicable law, disputes arising from these Terms or services will be brought in a court of competent jurisdiction in the county where Royal Tree Services maintains its principal Florida business location, unless otherwise agreed in writing.

33. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

34. Changes to These Terms

We may revise these Site Terms periodically.

Updated Terms will be posted on the Site with a revised “Last Updated” date.

Changes to these general Site Terms will not retroactively modify an existing signed project agreement unless permitted by law or agreed by the parties.
